THIS LICENCE AGREEMENT controls your right to use any image(s) downloaded from FotoAsia for general purposes. You agree to be bound by the terms hereof by downloading any image(s).

IN CONSIDERATION of the payment of the fees stated for downloading one or more photographic images from the FotoAsia web site (FotoAsia.com), and in further consideration of your acceptance of the provisions of this agreement, FotoAsia hereby grants you a personal, non-transferable, non-exclusive right to use such images subject to the following terms and conditions:

Use. You are licenced to use the image(s) worldwide for any of the following:
(A) Advertising and Promotion
(B) Corporate Communications
(C) Marketing Communications
(D) Online And Web Pages
(E) Editorial use
(F) Environmental Graphics

Improper use. Under no circumstances shall the image(s) be used for pornographic, libellous, defamatory or any other improper or illegal purposes.

Extended Use. Additional rights to use the image(s) on products for sale are available. For such extended use, please contact FotoAsia at sales@FotoAsia.com.

Ownership. All rights to the image(s) are owned by FotoAsia and its licensors and are protected by Singapore copyright laws, international treaties and other applicable laws. FotoAsia and its licensors retain any and all rights, titles and interests not expressly granted by this licence agreement. You may not distribute, transfer, assign or sub-licence the image(s) without the prior written consent of FotoAsia.

Model and Property Releases. All photographs do not have model or property releases unless otherwise stated.

Watermark. All FotoAsia images are digitally watermarked at point of purchase. In the event of a copyright dispute or improper use, these watermarks will be used as evidence in a court of law.

Warranties. FotoAsia warrants that the downloaded digital image(s) are free from defects in material and workmanship for seven (7) days from the time of downloading and delivery. Your sole and exclusive remedy for a breach of this warranty is the replacement of the image(s) or refund of the purchase price at the sole discretion of FotoAsia.

Damages. FotoAsia shall not be liable for any general, special, direct, indirect, incidental or consequential damages arising out of the licence and use of the image(s).

Notices. Any notices or requests to FotoAsia may be addressed to the company by e-mail at sales@FotoAsia.com or in writing to Managing Director, FotoAsia Pte Ltd, 11 Kallang Place, #06-09, Singapore 339155. Tel: 65-3981383. Fax: 65-3981393.

Termination. This agreement shall terminate upon violation of any of its provisions. Upon termination you must immediately stop using the image(s), delete all copies of such image(s) from your computer and all magnetic media.

Governing Law. This agreement shall be controlled by Singapore law and venue for any disputes arising hereunder shall be brought in the courts in Singapore.

NOTE: YOUR DOWNLOADING OF ANY IMAGE(S) CONSTITUTES YOUR CONSENT TO AND ACCEPTANCE OF THE FOREGOING IMAGE LICENCE.
